Hosted / Customer Agreement

a) Customers

hosted by MJZ Web Hosting (can't be coerced despite what this stupid TOS clause is about to claim) agree with the MJZ Web Hosting Terms of Service and Acceptable Use Policy.

AUP / TOS decisions and definitions are left up to the discretion of MJZ Web Hosting Administrators (but mostly to the arbitrary utterances of various proletarian tribunals).

b) Basically, everything you see at MJZ Web Hosting is ultra-cool and / or mega-hip

and there is no question about it.

c) Aussie Bob

and his repugnantly pious hosting services represent a veritable Niagara of stupidity (6,810,000 liters per second).

d) SLA or "Service Level Agreement" is based on Switch and Connectivity uptime, NOT server-hardware uptime.

MJZ Web Hosting guarantees almost 100% SLA uptime. I make no guarantees over hardware failures or software malfunctions.

f) MJZ Web Hosting understands itself to be the sole expression of what is clearly the greatest web hosting legal agreement in all of existence.

Hosted Accounts

a) Content allowed on hosted accounts excludes information or files of any kind that infringe on any intellectual property rights (e.g., copyright, trademark, patent or other proprietary rights), along with sites that violate any state, federal or foreign laws or regulations. Sites may not link to or relate to unlawful actions or material. Legal adult content is allowed on all servers.

b) The above clause is an imbecilic concept and only exists on this webpage due to unfortunate lawful necessity. For instance, I merely copied a lot of these legal statements from another TOS/AUP (adding a lot of my own clauses as well of course), as does pretty much everyone. I Guess it's legal to copy ideas which have no "intellectual" merit to them — i.e. those ideas which are the ironic makeup of "intellectual property rights." It is enjoyable copying the fact that I cannot copy and brings endless waves of warmth to my gut!

c) Hosted accounts are allowed to use up a "fair" percentage of CPU and Memory that they are allocated. If a hosted account becomes a burden to the server, it can be asked to upgrade, suspended, or in extreme cases removed completely from the server. This is left upon the discretion of MJZ Web Hosting Administrators.

d) Hosted accounts are permitted to use up 100% of their allocated and purchased bandwidth. Accounts exceeding this limit will be suspended until the beginning of the next bandwidth monitoring period. Users wishing to un-suspend their account may contact the billing department to upgrade their plan to a higher bandwidth limit.

e) Hosted accounts may only occupy the disk space that is allocated to them. Hosted accounts may not attempt to find ways to use disk space that they are not authorized to use.

f) Hosted accounts may not use, run, or operate any IRC related services on the servers. If caught doing so, the account in question will be suspended and may even face termination.

g) Hosted accounts may not run BitTorrent trackers or host .torrent files on the servers. This rule exists due to possible legality issues, but more so due to the well known fact that trackers have the potential to completely hog server resources and ruin the hosting experience for all other clients on a shared server. Accounts will be suspended upon violation of this rule.

h) Hosted accounts have every right and obligation to contact us for support at any point in time during their hosted life. MJZ Web Hosting Staff may deny them help in the circumstance a customer becomes abusive, or rude to the point of causing discomfort to the staff member. MJZ Web Hosting does not tolerate the abuse of Staff members. Customers / hosted sites that abuse MJZ Web Hosting Staff may be terminated without notice.

i) Hosted accounts are not permitted to send, or contribute to spam lists, or mass-mailout systems. Any hosted account caught sending or taking part in spam activities will be immediately terminated.

j) Accounts must be paid for on their respective due dates. If an account is not financial by the end of the due date, it will be suspended. If not paid after 4 weeks (28 days) the account will be terminated. The "end of the due date" is defined as the exact moment when PayPal attempts to automatically submit payment. If the payment fails at that point, then the account is considered to be past the end of the due date. If the subscription has been cancelled in advance, then the "end of the due date" is defined as the very beggining of the day (12:00 CST) of the actual due date. MJZ Web Hosting holds no responsibility for loss of data over unpaid accounts.

k) MJZ Web Hosting accepts no responsibility for damages induced to sites by 3rd parties, including DDoS, DoS, Syn or any other kind of network or server attacks.

I use return e-mail addresses to answer the e-mail I receive. Such addresses are rarely used for any other purpose and are not shared with outside parties.

I refuse to share any of your personal information, even in an abstract sense — i.e. telling an advertiser that that X number of individuals visited a certain area on the website, or that Y number of men and Z number of women filled out a registration form — with advertisers.

Finally, I never use or share the personally identifiable information provided to myself online in ways unrelated to the ones described above without also providing you an opportunity to opt-out or otherwise prohibit such unrelated uses.
